Ohio Supreme Court Holds Legal Invoices Must be Disclosed in Public Records Requests

In the case of State ex rel. Armatas v. Plain Twp. Bd. of Trustees, 2021-Ohio-1176, the Ohio Supreme Court addressed whether a decision to hire lawyers was a “delegation of a public duty of the township,” and if so, whether the legal invoices must be disclosed pursuant to a public records request.

The Court held the legal invoices were directly related to the hiring and supervising of lawyers, a delegated public duty on the part of the Township, and therefore the township must provide access to these legal invoices subsequent to a public records request.
