U.S. Department of Education Issues Proposed Change to its Title IX Regulations on Student Eligibility for Athletic Teams

On April 6, 2023, the U.S. Department of Education issued a new proposed regulation on Title IX, as well as a related fact sheet.

The proposed rule would affect the rights of transgender students to participate on athletic teams that align with their gender identity.

Please note that is a proposal, which has not gone into effect. Pursuant to the federal rulemaking process, the proposed regulations will be open for public comment for 30-days following publication in the Federal Register.
