Board of Zoning Appeals Must Oversee All Zoning Plans in the Township

In the Attorney General Opinion 2022 Ohio Atty.Gen.Ops. No. 2022-012, the Attorney General held that a township is not required to have a separate board of zoning appeals for each zoned area of the township pursuant to R.C. 519.13.

In this opinion, the question was asked whether a township is required to have a separate board of zoning appeals for each zoned area. The Attorney General responded in the negative.

In support of his opinion, the Attorney General explained that R.C. 519.13 requires only one board of zoning appeals to oversee multiple zoning plans or areas that may exist within the township. The Attorney General further explained that had the General Assembly intended for multiple board of zoning appeals to oversee multiple zoning plans and/or areas, it would have provided the appropriate language.
