Matthew John Markling Appointed to the Ohio State Bar Association Ad Hoc Committee on Foreclosures and Civil Justice

As an experienced attorney mediator, Matthew John Markling has been appointed as one of up to ten attorney mediators to serve on the Ohio State Bar Association Ad Hoc Committee on Foreclosures and Civil Justice.

On July 23, 2020, the Board of Governors of the Ohio State Bar Association voted to create an Ad Hoc Committee on Foreclosures & Civil Justice to help address the anticipated number of evictions and foreclosure cases that are likely to flood Ohio’s court system now that the federal moratorium on the filing of these cases previously imposed by the federal CARES Act will expire August 31, 2020.

The Ohio Supreme Court established a task force to help address this problem, and it issued a report asking that bar associations work with local courts to provide assistance in addressing this issue. As the Ohio State Bar Association has done in the past, most recently after the foreclosure crisis following the Great Recession in 2009, it has decided to be an integral part of a collaborative effort with the Ohio Supreme Court to address this very serious issue.

As a member of the Ohio State Bar Association Ad Hoc Committee on Foreclosures and Civil Justice, Mr. Markling will collaborate with Ohio courts to do the following:

  1. Assist with settlement events, helping to recruit experienced attorney mediators or experienced trial attorneys trained in mediation to help meet the demand posed by pending civil cases in need of resolution;
  2. Contribute to mediation training in alignment with the Rule of Superintendence 16.23: Mediation Education and Training;
  3. Encourage Ohio courts to utilize mediation more for foreclosure cases; and
  4. Offer ideas and suggestions for funding to pay qualified mediators.

The Ohio State Bar Association Ad Hoc Committee on Foreclosures and Civil Justice will work closely with the Ohio Supreme Court to ensure that it is addressing the issues in line with the Court’s Task Force recommendations.
