In May of 2021, the Ohio Department of Health established procedures that allow transgender individuals to correct the marker on their Ohio Birth Certificates. In order to change this maker, individuals must obtain a court-ordered correction of a birth certificate from an Ohio probate court.
This procedure comes after the United States District Court for the Southern District of Ohio found that the Ohio Department of Health’s denial of requests for sex marker changes was unconstitutional in the case Ray et al. v. Breda et al., which was decided in December of 2020.
