In the case of Shields v. Kelly Servs., Inc., 2021-Ohio-4018, the Eighth District Court of Appeals held that the trial court did not err in affirming a state review commission’s decision to deny an employee’s unemployment compensation claim.
Here, an employee argued that they were eligible for unemployment compensation because the employer did not provide a “suitable” work environment. The employer argued that the employee quit without just cause and was not entitled to this benefit.
The Court reasoned that though the employee considered the work environment unsuitable, the employee only terminated the position after accepting a new job. As such, the Court held that the employee did not quit with just cause and was not entitled to the unemployment compensation.
