Ohio Supreme Court Justices Eligible for Monetary Vaccine Incentive

In the formal opinion issued by the Ohio Attorney General (“AG”), the AG stated that justices on the Ohio Supreme Court are not disqualified from participating in the COVID-19 vaccination monetary incentive program.

Here, the AG analyzed Article IV, Section 6(B) of the Ohio Constitution which outlines what is and is not permissible judicial compensation.

The AG reasoned that though the Constitution prohibits perks beyond the statutorily-authorized compensation, there is nothing that prohibits increasing the statutorily-authorized compensation. As such, the COVID-19 monetary incentive program was found to be a statutorily-authorized increase in compensation, and the justices are now permitted to participate in the program.
