In the case State ex rel. Terra State Community College v. Ohio School Bd. Emps. Retirement Sys., 2021-Ohio-3652, the Tenth District Court of Appeals adopted the magistrate’s decision which recommended denial of a college’s writ of mandamus seeking to compel the School Employees Retirement System of Ohio Board (“SERS”) to vacate its determination awarding SERS service credit to an individual employee.
Here, the college argued that SERS abused its discretion by retroactively applying service credit in excess of $300,000 to the employee. The magistrate recommended denial of the college’s writ of mandamus, and the Court of Appeals adopted the recommendation.
The Court of Appeals reasoned that SERS did not abuse its discretion in determining that the individual was a public employee and therefore entitled to service credit.
