In the case of State ex rel. Delta Lookout, L.L.C. v. Cincinnati, 2021-Ohio-2192, the First District Court of Appeals issued an order requiring the City of Cincinnati to care for, supervise, and control statutorily dedicated public streets.
Here, the Court of Appeals addressed the Ohio Supreme Court’s decision which ruled that the streets are public, thereby requiring the Court to determine if the companies were entitled to an order that the city maintain the streets.
The Court of Appeals determined that because there was no other adequate remedy for the company, the City of Cincinnati must care for, supervise, and control the public streets.
